This website and all related websites (“Farmers Weekly”), and all associated content and material (“Content”) is owned by AgriHQ Limited (“Farmers Weekly”) and is protected by copyright.

Unauthorised use of any Content is strictly prohibited and may infringe on intellectual property rights held by Farmers Weekly. Copyright of some material may be held by the suppliers of Farmers Weekly, in which case the suppliers retain all rights.

Terms of Use

In accordance with the terms of our Copyright, no Content may be reproduced, published, or, transmitted in any manner without the prior written permission of Farmers Weekly.

Farmers Weekly grants non-exclusive and non-transferable licences for any Content for your personal, internal business, information, research or study only, but no form of distribution for making available to third-parties, except where permission is given, whether in print or electronic form, of any Content is permitted. Farmers Weekly provides no warranty as to the accuracy or correctness of information supplied.

You agree to use Farmers Weekly in a manner that complies with all applicable laws and regulations and that does not infringe our right or the right of anyone else, and that does not restrict or inhibit anyone else’s use of the Content.

In particular you agree not to:

(a)      damage or harm Farmers Weekly, or any underlying or connected network or system                

(b)    use a harvesting bot, robot, spider, scraper, or other unauthorised automated means to access Farmers Weekly or Content featured on them for any purpose;

(c)      introduce any viruses, content or code to Farmers Weekly which are technologically harmful;

(d)      use Farmers Weekly to do anything unlawful, misleading; 

(e)      do anything that could disable, overburden, or impair the proper function of Farmers Weekly;

(f)      facilitate or encourage any violations of these Terms of Use.

Farmers Weekly and Dairy Farmer Print Subscriptions

(a) Understand that it can take 5 or more working days for delivery of each weeks/months paper/magazine.

(b) Agree that cancellations and refunds requested more than 48 hours after purchase are provided only at the discretion of AgriHQ . Subscriptions may be refunded in full, in part, or not at all. Under the Consumer Guarantees Act 1993, AgriHQ is not obliged to refund if you have simply changed your mind, found a product we sell cheaper somewhere else, decided you did not like the purchase or had no use for it.

(c) Agree that exchanges from one title to another are at the discretion of AgriHQ.

(d) Agree that if a subscription invoice is paid twice an offer of an extension or refund will be made. If the subscriber does not reply to AgriHQ’s attempts to contact them within two weeks of the initial overpayment, their subscription will be automatically extended.

Terms of Access

We welcome requests to use Farmers Weekly’s Content and printed publications on third-party websites. In accordance with the terms of our Copyright, this requires our prior written permission.

In granting you access, Farmers Weekly retains all rights, including the right to end this agreement at any time, and order the removal of any Content at any time. Farmers Weekly provides no warranty as to the accuracy or correctness of information supplied.

All Content accessed and displayed under this agreement must carry the following acknowledgement and links to Farmers Weekly:

  • Content supplied by Farmers Weekly.
  • Copyright and Terms of Use.

Disclaimer

The Content is derived from various sources believed to be accurate and current as at the date specified in the relevant Content.  

However due to the number of sources from which materials may be obtained and the inherent hazards of electronic distribution, Farmers Weekly, its parent and related companies, and its directors, officers, agents, employees or contractors do not give any representation or warrant as to the liability, accuracy or completeness of the Content.  

Neither Farmers Weekly, its parent or related companies, nor their officers, employees and agents shall under any circumstances be liable in any way for any loss of direct, consequential, incidental, indirect or special damages of any kind or any other damages howsoever arising (whether in negligence or otherwise) out of or in connection with the Content and/or any omission from the Content, including, without limitation those arising from:

(a)         any decision made or action taken in reliance upon the Content;

(b)         loss of use, data or profits whether arising from use of or inability to use any Content;

(c)         contingencies outside the control of Farmers Weekly, its parent or related companies, their officers, employees or agents; or

(d)         any other cause.

except where liability is made non-excludable by legislation. Any clause, or part thereof, declared invalid shall be deemed severable and not affect the validity or enforceability of the remainder.

Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless and defend Farmers Weekly, its parent and related companies and their directors, officers, employees and agents against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages incurred or suffered by any of them arising from all uses of Farmers Weekly, and any reliance upon any Content.

Governing Law and Jurisdiction

The use of Farmers Weekly and these Terms of Use shall be governed by the laws of New Zealand. Any legal action arising out of its use shall be brought and enforced under the laws of New Zealand shall be within the exclusive jurisdiction of the courts of New Zealand.

Changes to Terms of Use

We reserve the right to alter these Terms of Use at any time and without notice.

Privacy Policy

This Privacy Policy applies to your use of the Farmers Weekly websites, farmersweekly.co.nz and all of its related websites (“Sites”) and the information technology systems and networks relating to the Sites. In this Policy, any references to “Farmers Weekly”, “Dairy Farmer” or “On Farm Story” are to “AgriHQ Limited”, its parent and related companies, and all of their respective directors, officers, agents, employees or contractors.

Non-Personal Information

When you use the Sites, systems and networks, our server, our agent’s or contractor’s server, and third parties in the internet infrastructure (“Servers”) log certain information, which is provided by your browser, such as:

  • your server’s IP address (a number which is unique to the machine through which you are connected to the Internet) or your personal IP address;
  • the type of browser and operating system you are using; 
  • the domain name of the referring site; and
  • emails between you and us.

The Servers also log:

  • the date and time of your visit; and
  • the URL address of the pages accessed and the documents downloaded.

We use this information for a number of purposes connected with the usage of our Sites, and to monitor the security of our Sites, systems and networks. Among other possible uses, Farmers Weekly may use this information to analyse certain trends and statistics, such as which parts of the Sites users are visiting and how long they spend there, and to monitor the security of our Sites, systems and networks.

Farmers Weekly will not try to identify you or your browsing activities through the information set out above except, in the event of an investigation, where a law enforcement agency may exercise a warrant to inspect the logs or if your usage is causing technical issues for the Site that may need to be resolved. Farmers Weekly may in these circumstances identify your IP address to enable Farmers Weekly to contact you.

Cookies

The Sites use cookies. A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. The Sites use cookies to help Farmers Weekly identify and track visitors, their usage of the Sites, and their Site access preferences. Farmers Weekly may use cookies on behalf of AgriHQ Limited for AgriHQ Limited purposes including tailoring our services to meet your needs. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Sites, with the drawback that certain features of the Sites may not function properly without the aid of cookies.

Farmers Weekly uses Google Analytics to analyse the use of the Sites. Google Analytics uses cookies to collect, store, and transmit information about your use of the Site to Google. Further information about how Google Analytics collects and processes data can be found at the following link: http://www.google.com/policies/privacy/partners/.

Farmers Weekly also uses the Google Analytics Display Advertising feature ‘Demographics and Interests Reporting’ which enables Google Analytics to collect data about the age, gender and interests of visitors to our Sites via cookies and anonymous identifiers. Google will collect, store, and use this information to create statistical reports about the use of the Sites.

Farmers Weekly has enabled Google Analytics, Advertising Features on our website. This allows us to use Remarketing with Google Analytics through Google AdWords and allows us to pull Display Network Impression Reporting, Google Analytics Demographics and Interest Reporting and also Integrated services that require Google Analytics to collect data via advertising cookies and anonymous identifiers.

We use these cookies to remember your most recent searches/webpages on our site and your previous interactions so we can make our Google AdWords advertising more engaging and relevant to something you may be interested in.

Providing Personal Information

Provide Details: When you access the certain services, you will be asked to voluntarily provide your name and email Address. Farmers Weekly will not be able to provide you these services if you do not provide these details.

Subscription emails: By providing Farmers Weekly with your email Address and Password and selecting the option to receive emails you consent to receive emails from Farmers Weekly that relate to your subscription, and to any functions of the subscription you choose (whether by express or implied consent). Farmers Weekly may send you information based on the parts of the Sites that you visit.

For the purposes of optimising the emails, and tailoring those emails to your interests, Farmers Weekly will also collect information about the Content you click on, read about or choose to receive information about.

If you no longer wish to receive correspondence from Farmers Weekly, please unsubscribe using the link in the email.

Personal Information

Farmers Weekly collects and holds personal information about you through your use of the Sites, including your registration details and information relating to your use of the Sites and the content you access.

Farmers Weekly collects this information for the purposes of conducting market research surveys, conducting statistical analysis of usage of the Sites, running competitions, determining advertising content, marketing, monitoring the security if Site, our IT systems and our networks and tailoring our services to match your needs and improving the Sites generally.

Farmers Weekly does not collect sensitive information such as your racial or ethnic origin, political opinions or religious beliefs.

The personal information collected by Farmers Weekly will be held in third party data centres, and may be shared with third party organisations for security purposes.

Farmers Weekly will only use such personal information for the purpose for which you have provided it, unless you consent otherwise or Farmers Weekly is required by law to disclose it or Farmers Weekly is otherwise permitted to use it under the Privacy Act 1993.

Farmers Weekly will not sell your personal information to, or share it with, any other company outside of the Farmers Weekly group or third party agency other than as set out in this Privacy Policy, except as permitted by law. Farmers Weekly will disclose such personal information about you only to those employees of Farmers Weekly, its parent or related companies, on a need to know basis.

You can access or request a correction to your personal information by writing to Farmers Weekly at PO Box 529, Feilding, or by sending an email to subs@agrihq.co.nz Farmers Weekly will correct personal information if we are satisfied that it is incorrect and will otherwise comply with our obligations under the Privacy Act 1993.
